More Juries, Less Violent Crime

During my term as district attorney, there will be a significant shift in focus. Resources will be diverted away from prosecuting “crimes” that have no victim and towards prosecuting every individual in the county who has committed violent crimes injuring real victims. Those violent aggressors will be prosecuted to the fullest extent law allows. There will be zero plea deals for violent offenders. Zero. If you use fraud or unjustified force to injure any living person in Clark County, you will face a jury of 12 people to defend your actions. You will not be offered a deal of any kind.

I promise to prosecute every violent offender in front of a fully informed jury of ones peers.

If you drink a beer on Fremont Street, I will not have the resources available to prosecute you. Me and my staff will be busy prosecuting actual criminals, with real victims.

I am willing to let jaywalkers, seat-belt offenders, motorcyclists without helmets, and a host of other non-violent people go free because it will allow me to try every violent offender in front of a fully informed jury of their peers. Victims of violent crime will have Justice and their Rights respected.

This policy shift towards prosecuting violent criminals in front of a fully informed jury of their peers and away from generating revenue by persecuting persons accused of crimes that have no victims will result in a safer community with less violence, more freedom, and more fun. It's not just the right thing to do, it's required by the highest law in the land, the Constitution.

Safety and Happiness

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.--That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, --That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness.

When the American colonists declared Independence from the kingdom of Britain they declared in our national charter that the inalienable Rights of Life, Liberty, and the Pursuit of Happiness also included the Right to a consentual government that is most likely to effect our Safety and Happiness.

Nevada enacted similar language in its Constituion:

“All men are by Nature free and equal and have certain inalienable rights among which are those of enjoying and defending life and liberty; Acquiring, Possessing and Protecting property and pursuing and obtaining safety and happiness.” - Constitution of Nevada – Article 1 Section 1

Under a Duensing administration the District Attorney's office would not be wasting resources on revenue generating Pretended Offences. Instead, the District Attorney's office would prosecute ANY AND ALL violations of your individual Rights by ANY AND ALL levels of government or individuals.

Any agents of the federal, state, or local government engaged in any unconstitutional or illegal acts under the color of law will face a Grand Jury. The Constitution of the United States has never been repealed. Those who violate their oath and so much as attempt to engage in unConstitutional behavior will be brought before a Grand Jury and tried for their crimes.

Under a Duensing Administration, what happens in Vegas will be Constitutional.

Accountability in Government

Power corrupts and absolute power corrupts absolutely. It was true in Roman times when Acton first said it. It is true today.

For far too long, those entrusted with upholding the law have been unaccountable to We the People. Homicides committed by agents of the Las Vegas Metropolitan Police Department have gone unpunished. The dead have been smeared posthumously while those who pulled the trigger have been protected from any serious inquiry into their official actions committed in the name of We the People.

This has been allowed to happen not just because the Las Vegas Metropolitan Police Department has come under bad leadership, but also because past and present Clark County prosecutors have failed to hold those agents accountable for their official actions.

Under my administration, I will convene Fully Informed Grand Juries to inquire into several deaths that have been the result of government agents that have gone unpunished. These incidents include, the killing of Erik Scott outside of the Summerlin Costco, the killing of war hero Stanley Gibson as he sat unarmed in his disabled vehicle, and the killing of Trevon Cole, shot in the head on his knees in his own bathroom after the shooter lied on the arrest warrant. These and other incidents must not go unpunished in a free country where We the People are actually in control of our government. Such incidents are the hallmark of totalitarian regimes, because where the people fear the government there is tyranny. Where the government fears the people, there is Liberty.

Under my administration everyone will be held accountable. No one will have a permit to kill. No one will be above the Law.
